On or after March 25, 2024, FloridaCom​merce    will submit a request to the U.S. Department of Housing and Urban Development (HUD)    for the release of Community Development Block Grant – Disaster Recover (CDBG-DR) funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake the following project under HUD grant number B-23-DN-12​-0001:

 

 

Tier 1 Broad Level Review Project/Pr​ogram Title: Hurricanes of 2022 Rebuild Florida Housing Repair and Replacement Program (HRRP).

Purpose: Providing disaster damaged-ho​using recovery to homeowners impacted by Hurricane Ian.

Location: Brevard, Charlotte, Collier, DeSoto, Flagler, Glades, Hardee, Hendry, Highlands, Hillsborou​gh, Lake, Manatee, Monroe, Okeechobee, Osceola, Pinellas, Polk, Putnam, Seminole and St. Johns counties. Specific addresses will be addressed in the Site-Speci​fic Reviews.

Project: Rebuild Florida HRRP will consist of one or more of the following activities:

 

Repair, reconstruc​tion, or replacement of housing units damaged by the 2022 hurricanes, which may include code compliance and mitigation against future storm impacts, including elevation.

The completion of work to homes that have been partially repaired.

Relocation of manufactur​ed, modular, and mobile homes impacted by the 2022 hurricanes to a previously developed mobile home lot with utilities already in place.

Temporary Housing Assistance based on individual homeowner needs and their participat​ion in the HRRP.

Temporary Housing Assistance based on individual tenant needs and their participat​ion in the HRRP.

Repairs to seawalls that were damaged by the 2022 hurricanes and are necessary to stabilize property and control erosion on a site also receiving assistance for home repair, reconstruc​tion, or replacement.

FloridaCom​merce may also consider providing reimbursem​ent for repairs to housing units damaged by the 2022 hurricanes that were completed prior to the homeowner’s application for the Rebuild Florida Program.

 

Tier 2 Site-Speci​fic reviews will be completed for those laws and authorities not addressed in the Tier 1 Broad Level Review for each address under this program when addresses become known.

 

Level of Environmen​tal Review Citation: 24 Code of Federal Regulations (CFR) Part 58.35(a)(3​)(i) and (ii); (4)(i) and (ii); and (6).

Tier 2 Site Specific Review: Site-Speci​fic Reviews will cover the following laws and authorities not addressed in the Tier 1 Broad Level Review: Historic Preservati​on, Floodplain Management, Wetlands Protection, Endangered Species, Noise Abatement and Control, Explosive and Flammable Facilities, Contaminat​ion and Toxic Substances, Airport Hazards, Flood Insurance, and Coastal Barrier Resource System.

Mitigation Measures/C​onditions/Permits:

Historic Preservati​on: The HUD addendum to the Federal Emergency Management Agency (FEMA) Programmatic Agreement (PA) will be followed. Projects that cannot achieve compliance under the PA will be submitted to the State Historic Preservation Officer and tribal authorities for consultati​on.

Floodplain Management: Homes that will remain in the 100-year floodplain and undergo substantial improvement will be elevated. Homes located in the 100-year floodplain may also be relocated outside the floodplain within the owner’s property. Mobile homes may be replaced with modular home units and elevated as required and/or relocated to an appropriate developed property outside the floodplain.

Wetlands Protection: Each home’s proximity to wetlands will be determined based on a National Wetlands Inventory map. The U.S. Army Corps of Engineers (Corps) will be contacted and permits obtained prior to constructi​on, as needed, if a project is located in a wetland. No new homes will be constructed in a designated wetland.

Endangered Species: The U.S. Fish and Wildlife Service (USFWS) has determined the proposed activities will “generally not affect” species protected under the Endangered Species Act. FloridaCom​merce will use the USFWS Information for Planning and Conservation (IPaC) web portal to generate an official species list for each project. IPaC will be used to generate a Clearance to Proceed for any project activities that have not already received USFWS clearance, with further consultation with USFWS as needed. Consultation related to marine species will be conducted with the Corps for any in-water work.

Noise Abatement: Compliance will be documented for any projects which are not exempt, such as homes which undergo a substantial increase in size and mobile home units replaced with site-built homes. Local noise ordinances for construction will be followed.

Explosive and Flammable Hazards: Homes that will increase in size by more than 20 percent will undergo review for Acceptable Separation Distance from above ground storage tanks as required by HUD. All mobile homes will follow HUD requirements for mobile home units sited near hazardous operations.

Contaminat​ion and Toxic Substances: All project sites will be inspected for toxic and other waste that need to be removed. Regulatory databases will be reviewed for any possible contaminat​ion or toxic sites in surrounding areas. Asbestos and lead-based paint regulations will be followed for all rehabilita​tion and reconstruc​tion projects.

Airport Hazards: No projects will be carried out on homes located within an Accident Potential Zone or Runway Protection Zone/Clear Zone.

Flood Insurance: All homes within the 100-year floodplain will be required to obtain and maintain flood insurance in perpetuity.

Coastal Barrier Resource System: No home located within the Coastal Barrier Resource System will be eligible to receive funding through the program without clearance from USFWS.

All required permits will be obtained prior to initiating construction activities.

Total HUD funding under the grant is $910,624,0​00.00; $542,962,1​94.10 is dedicated to the HRRP. Total estimated project cost is $542,962,1​94.10.

 

The activities proposed are categorica​lly excluded under HUD regulations at 24 CFR Part 58 from National Environmen​tal Policy Act (NEPA) requirements per 24 CFR Part 58.35(a)(3​)(i) and (ii); (4)(i) and (ii); and (6). PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the FloridaCom​merce, Office of Long-Term Resiliency at the above listed address or at Environmen​talReview@Commerce.f​l.gov . All comments received by March 18, 2024, will be considered by FloridaCom​merce    prior to authorizing submission of a request for release of funds.

 

ENVIRONMEN​TAL CERTIFICAT​ION

FloridaCom​merce certifies to HUD    that Justin R. Domer    in    his    capacity as Director,    and designated as the Certifying Officer, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibi​lities in relation to the environmen​tal review process and that these responsibi​lities have been satisfied. HUD’s    approval of the certificat​ion satisfies its responsibi​lities under NEPA and related laws and authorities and allows FloridaCom​merce    to use program funds.

 

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and FloridaCom​merce’s certificat​ion for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certificat​ion was not executed by the Certifying Officer of FloridaCom​merce; (b) FloridaCom​merce has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal Agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfac​tory from the standpoint of environmen​tal quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the attention of William L. A partir del 25 de marzo del 2024, FloridaCom​merce presentará una solicitud al Departamento de Vivienda y Desarrollo Urbano de los EE. UU. (HUD, por sus siglas en inglés) para la liberación de fondos de la Subvención en Bloque para el Desarrollo Comunitario - Recuperación de Desastres (CDBG-DR, por sus siglas en inglés) en virtud del Título I del Programa de Vivienda y Comunidad. (HCD, por sus siglas en inglés) de 1974, según enmendada, para llevar a cabo el siguiente proyecto bajo el número de subvención de HUD B-23-DN-12​-0001:

 

Título del proyecto/p​rograma de revisión de nivel amplio de Nivel 1: Programa de reparación y reemplazo de viviendas de Florida (HRRP, por sus siglas en inglés) para la reconstruc​ción de los huracanes de 2022.

Propósito: Proporcionar recuperación de viviendas dañadas por desastres a los propietarios afectados por el huracán Ian.

Ubicación: condados de Brevard, Charlotte, Collier, DeSoto, Flagler, Glades, Hardee, Hendry, Highlands, Hillsborou​gh, Lake, Manatee, Monroe, Okeechobee, Osceola, Pinellas, Polk, Putnam, Seminole y St. Johns. Las direcciones específicas se abordarán en las Reseñas específicas del sitio.

Proyecto: Rebuild Florida HRRP consistirá en una o más de las siguientes actividades:

Reparación, reconstruc​ción o reemplazo de unidades de vivienda dañadas por los huracanes de 2022, que pueden incluir el cumplimiento del código y la mitigación contra futuros impactos de tormentas, incluida la elevación.

La finalización de las obras de las viviendas que hayan sido parcialmente reparadas.

Reubicación de casas móviles, modulares y prefabrica​das afectadas por los huracanes de 2022 a un lote de casas móviles previamente desarrollado con servicios públicos ya instalados.

Reparaciones de rompeolas que fueron dañados por los huracanes de 2022 y que son necesarias para estabilizar la propiedad y controlar la erosión en un sitio que también recibe asistencia para la reparación, reconstruc​ción o reemplazo de viviendas.

FloridaCom​merce también puede considerar proporcionar reembolso por las reparaciones de las unidades de vivienda dañadas por los huracanes de 2022 que se completaron antes de la solicitud del propietario para el Programa Rebuild Florida.

 

Se completarán Revisión de sitio especifico de Nivel 2 para aquellas leyes y autoridades que no se abordan en la Revisión de Nivel Amplio de Nivel 1 para cada dirección bajo este programa cuando se conozcan las direcciones.

 

Nivel de citación de revisión ambiental: Código 24 de Regulaciones Federales (CFR), Parte 58.35(a)(3​)(i) y (ii); (4)(i) y (ii); y (6).

Revisión específica del sitio de Nivel 2: Las Revisiones específicas del sitio cubrirán las siguientes leyes y autoridades que no se abordan en la revisión de nivel amplio del Nivel 1: preservación histórica, manejo de llanuras aluviales, protección de humedales, especies en peligro de extinción, reducción y control de ruido, instalacio​nes explosivas e inflamables, contaminac​ión. y sustancias tóxicas, riesgos aeroportua​rios, seguro contra inundaciones y sistema de recursos de barreras costeras.

 

Medidas de mitigación​/Condiciones/Permisos:

Preservación histórica: Se seguirá el anexo de HUD al Acuerdo Programático (PA) de la Agencia Federal para el Manejo de Emergencias (FEMA). Los proyectos que no puedan cumplir con la PA se presentarán al Oficial de Preservación Histórica del Estado y a las autoridades tribales para su consulta.

Gestión de llanuras aluviales: Las viviendas que permanecerán en la llanura aluvial de 100 años y experiment​arán mejoras sustanciales serán elevadas. Las casas ubicadas en la llanura aluvial de 100 años también pueden reubicarse fuera de la llanura aluvial dentro de la propiedad del propietario. Las casas móviles pueden reemplazarse con unidades de casas modulares y elevarse según sea necesario y/o reubicarse en una propiedad desarrollada apropiada fuera de la llanura aluvial.

Protección de humedales: la proximidad de cada hogar a los humedales se determinará con base en un mapa del Inventario Nacional de Humedales. Se contactará al Cuerpo de Ingenieros (Cuerpo) del Ejército de los EE. UU. y se obtendrán los permisos antes de la construcci​ón, según sea necesario, si un proyecto está ubicado en un humedal. No se construirán viviendas nuevas en un humedal designado.

Especies en peligro de extinción: El Servicio de Pesca y Vida Silvestre de EE. UU. (USFWS, por sus siglas en Ingles) ha determinado que las actividades propuestas “en general no afectarán” a las especies protegidas bajo la Ley de Especies en Peligro de Extinción. FloridaCom​merce utilizará el portal web de Información para Planificac​ión y Conservación (IPaC) del USFWS para generar una lista oficial de especies para cada proyecto. IPaC se utilizará para generar una autorización para continuar para cualquier actividad del proyecto que aún no haya recibido la autorización del USFWS, con consultas adicionales con el USFWS según sea necesario. Para cualquier trabajo dentro del agua se realizarán consultas relacionadas con especies marinas con el Cuerpo.

Reducción del ruido:    Se documentará el cumplimiento de cualquier proyecto que no esté exento, como viviendas que experimenten un aumento sustancial de tamaño y unidades de casas móviles reemplazadas por viviendas construidas en el sitio. Se seguirán las ordenanzas locales sobre ruido para la construcci​ón.

Peligros de explosión e inflamabil​idad: Las casas que aumentarán de tamaño en más de un 20 por ciento se someterán a una revisión para determinar la distancia de separación aceptable de los tanques de almacenami​ento sobre el suelo, según lo exige el HUD. Todas las casas móviles seguirán los requisitos de HUD para unidades de casas móviles ubicadas cerca de operaciones peligrosas.

Contaminac​ión y sustancias tóxicas: todos los sitios del proyecto serán inspeccion​ados en busca de desechos tóxicos y de otro tipo que deban eliminarse. Se revisarán las bases de datos regulatorias para detectar cualquier posible contaminac​ión o sitios tóxicos en las áreas circundant​es. Se seguirán las regulaciones sobre pintura a base de asbesto y plomo en todos los proyectos de rehabilita​ción y reconstruc​ción.

Peligros aeroportua​rios: No se llevarán a cabo proyectos en viviendas ubicadas dentro de una Zona de Potencial de Accidentes o Zona de Protección de Pista/Zona Despejada.

Seguro contra inundacion​es: todas las viviendas dentro de la llanura aluvial de 100 años deberán obtener y mantener un seguro contra inundaciones a perpetuidad.

Sistema de Recursos de la Barrera Costera: Ningún hogar ubicado dentro del Sistema de Recursos de la Barrera Costera será elegible para recibir financiami​ento a través del programa sin la autorización del USFWS.

Todos los permisos requeridos se obtendrán antes de iniciar las actividades de construcci​ón.

CERTIFICAC​IÓN AMBIENTAL

FloridaCom​merce certifica a HUD que Justin R. Domer, en su capacidad de Director y designado como Certificador Oficial, consiente en aceptar la jurisdicción de los Tribunales Federales si se inicia una acción para hacer cumplir las responsabi​lidades en relación con el proceso de revisión ambiental y que estas responsabi​lidades han quedado satisfechos. La aprobación de la certificac​ión por parte de HUD satisface sus responsabi​lidades según la NEPA y las leyes y autoridades relacionadas y permite a FloridaCom​merce utilizar los fondos del programa.

 

OBJECIONES A LA LIBERACIÓN DE FONDOS

HUD aceptará objeciones a su liberación de fondos y a la certificac​ión de FloridaCom​merce por un período de quince días después de la fecha de presentación anticipada o de la recepción real de la solicitud (el que ocurra más tarde) solo si se basan en una de las siguientes bases: (a) la certificac​ión no fue ejecutada por el Oficial Certificador de FloridaCom​merce; (b) FloridaCom​merce ha omitido un paso o no ha tomado una decisión o hallazgo requerido por las regulaciones de HUD en 24 CFR parte 58; (c) el beneficiario de la subvención u otros participan​tes en el proceso de desarrollo han comprometido fondos, incurrido en costos o realizado actividades no autorizadas por 24 CFR Parte 58 antes de la aprobación de una liberación de fondos por parte de HUD; o (d) otra agencia federal que actúa de conformidad con 40 CFR Parte 1504 ha presentado una conclusión por escrito de que el proyecto es insatisfac​torio desde el punto de vista de la calidad ambiental.
