This private matter concerns a “mortgage” filed in the county of HARRIS in the State of TEXAS, regarding Assessor Film Code No. 661210 of the map records A.P.N.: 1351740020008, with your association “FLAGSTAR BANK also known as FLAGSTAR BANCORP, INC. – Loan No. 504743559.  Aurora M. Sarmiento (debtor/grantor) transferred all real and personal property to ALCORTA EXPRESS TRUST (secured party & grantee) on 01/02/2018.  The trust organization exercises its interest in a lien expressed and/registered with the TEXAS Secretary of State – UCC Financing Statement No. 391463 (attached).  The actual value and consideration received was and is $9,000,000,000.00 (money in species) given to the debtor from the Trust to which the Trust has first right of claim as a creditor to administrate a legal process. This matter is being brought for a second time to the attention of the Miguel Sanchez “Chief Executive Officer,” refer in your file for previous correspondence on July 29, 2022, from settlor Aurora M. Sarmiento (debtor/grantor) as the real party in interest under FRCP Rule 17.

 

This “lender” and/or alleged “creditor” is claiming that it had given consideration in the form of a loan or credit to AURORA MARIA SARMINETO.  However, there is no such loan registered according to Article 9 of the Uniform Commercial Code with the Secretary of State.  All loans must be registered on a non-UCC lien with the “certificate of title” as a debt against AURORA M. SARMIENTO for the right to motion for a judgment in the event of default.  Through discovery there is no actual lien on the property known as 19010 Grove Valley Trl.  Houston, Texas 77084, against the name AURORA MARIA SARMIENTO.  Furthermore, there was never a transfer of lien on a UCC 3, which is an assignment.  Your domestic company is not following UCC law.  The Trust is challenging the “lender” and /or alleged “creditor” or third-party debt servicer to begin a real party of interest for inadequate consideration of tan alleged registered loan contract, which the claimant is claiming to have given lawful consideration in equity.  Secondly, the “lender” and/or alleged “creditor” or third-party debt servicer must adhere to the National Bank Act of 1863, section 33, which states,

 

And be it further enacted, That it shall be unlawful for any officer acting under the provisions of this act to countersign or deliver to any such association, or to any other company or person, any circulating notes contemplated by this act, except as hereinbefore provided, and in accordance with the true  intent and meaning of this act; and any officer who shall violate the provisions of this section shall be deemed guilty of a high misdemeanor, and on conviction thereof shall be punished by fine not exceeding double the amount so countersigned and delivered, and imprisonment not exceeding fifteen years, at the discretion of the court in which he shall be tried.

 

T A K E   N O T I C E, the note and the mortgage are inseparable.  An assignment of the note carries the mortgage with it, while an assignment of the latter alone is a nullity. “Carpenter v. Longan, 83 U.S. 274 (1872); accord Henley v. Hotaling, 41 Cal. 22, 28 (1871); Seidell v. Tuxedo Land Co., 216 Cal. 165, 170 (1932); Cal. Civ. Code §2936.  Therefore, if one party receives the note and another receives the deed of trust, the holder of the note prevails regardless of the order in which the interest were transferred.  Adler v. Sargent, 109 Cal. 42, 49-50 (1895).   It is FACT, in the First National Bank of Montgomery – Defendant V. Jerome Daly – Plaintiff (IN JUSTICE COURT, TOWNSHIP OF CREDIT RIVER, MARTIN V. MAHONEY, JUSTICE).

 

“Mr. Morgan (Defendant) admitted that all of the money or credit which was used as a consideration was created upon their books, that this was standard banking practice exercised by the bank in combination with the Federal Reserve Bank of Minneapolis, another private Bank, further he know of no United States Statute or Law that give the Plaintiff the authority to do this.  Plaintiff further claimed that the Defendant by using the ledger book created credit and by paying on the Note the Mortgage waived any right to complain about the Consideration and that Defendant was estoppped form doing so.”

 

The Trust offers you an opportunity to cure under the rules of the National Bank Act, Title 12 U.S. Code §411 and Title 31 U.S. Code §3113 as The Trust is prepared to present the case in court.  Please provide the following:

The District Board of Trustees of Seminole State College of Florida announces a Joint Board Workshop with the Seminole County Public School (SCPS) Board and Regular Board meeting in which all persons are invited to attend.

Seminole State College District Board of Trustees welcomes public comments during its monthly meetings.  Any person or group wishing to make public comments should arrive at the meeting early and complete a “Public Comment Card.”  (Available during each Board meeting.)  All documents submitted to the Board of Trustees will be retained as part of the public record of the meeting.  Procedures for making Public Comment are as follows:

1)  Complete comment card including your name, address, telephone number and agenda item number (if appropriate).

2)  Submit the completed card to Board Assistant Meghann Sellers, who will be seated in the rear of the Board Room.  When your name is called, approach the audience podium and state your name and address for the record.

3)  Comments are limited to three (3) minutes for an individual and five (5) minutes for a group.
